Terms of Service

Welcome to Play Strong LLC. By accessing or using our website and services, you agree to the following Terms of Service.

1. Services

Play Strong LLC provides private and adaptive swim lessons for children of all abilities. Lesson duration, location, and fees are confirmed before each session. Students must be able to follow basic safety instructions. If a student's behavior poses a risk to themselves, the instructor, or others, Play Strong LLC reserves the right to end the session early or discontinue services.

2. Payments

Lessons are purchased on a biweekly or monthly basis and are paid for in advance at the time of purchase. No package may extend beyond the end of the current calendar month. Receipts and invoices can be provided for scholarship or reimbursement programs such as Step Up for Students.

3. Lessons Ended Early and Late Arrivals

The rules in this section apply to lessons that begin and are then cut short. Cancellations and missed lessons are governed by Section 4.

Because lessons are paid for in advance, the rules below describe how much of a lesson's pre-paid value is retained by Play Strong LLC and how much is returned to the client as Account Credit (defined in Section 4).

Play Strong LLC offers 30-minute, 45-minute, and (on occasion) 60-minute lessons. The base rate is the minimum lesson fee charged by Play Strong LLC, as confirmed on the client's booking confirmation and invoice at the time of purchase. A 30-minute lesson is priced at the base rate.

If a lesson begins and must end early due to circumstances beyond the instructor's control, the amount retained is never less than the base rate:

  • For a 30-minute lesson, the full base rate is retained and no Account Credit is returned.

  • For a 45-minute or 60-minute lesson, Play Strong LLC may, at its discretion, retain either the base rate as a minimum or a prorated amount calculated in 15-minute increments (each increment that has begun retained in full), up to the full lesson value. Any portion not retained is returned as Account Credit, and the amount retained will never fall below the base rate or exceed the full lesson value.

If a student arrives late, the lesson still ends at its originally scheduled time. The full lesson value is retained and no Account Credit is returned.

Lessons canceled by the instructor due to weather or unsafe conditions are rescheduled at no additional cost. See Section 4 for details.

4. Missed Lesson, Token, and Credit Policy

Play Strong LLC uses a token system to manage missed lessons. Two terms are used throughout this section:

A Token is an allowance that permits a student to miss a scheduled lesson. An Account Credit is a dollar value applied toward the client's next purchase of lessons.

Tokens

Tokens are granted outright at the time of purchase, one Token for every 4 lessons purchased, up to a maximum of 3 Tokens. Because no package may extend beyond the end of the current month, Tokens expire at the end of the calendar month in which they are issued and do not carry over.

In addition to these Tokens, each student is allowed 1 sick day per month regardless of the number of lessons purchased.

How a missed lesson is handled

When a lesson is missed and a Token is available, the outcome depends on how much notice is given:

  • Cancellation more than 1 hour before the scheduled start time consumes 1 Token. The lesson may be rescheduled before the end of the current month. If no reschedule slot is available, the full dollar value of the lesson is converted to Account Credit.

  • Cancellation 1 hour or less before the scheduled start time consumes 1 Token. The lesson may not be rescheduled. 50% of the lesson's dollar value is applied as Account Credit, and the remaining 50% is forfeited. In all cases, Play Strong LLC retains no less than the base rate (defined in Section 3), so if 50% of the lesson's value is below the base rate, the base rate is retained and only the remainder is applied as Account Credit.

  • Cancellation upon arrival consumes 1 Token. No reschedule and no Account Credit are provided.

  • No-show consumes 1 Token. No reschedule and no Account Credit are provided.

When Tokens are exhausted

Once a student's Tokens for the month are used, any further missed lesson is forfeited in full, with no reschedule, rollover, or Account Credit, regardless of the notice given.

Sick days

A sick cancellation made more than 1 hour before the scheduled start time uses the sick day and is treated as a clean miss: it may be rescheduled before month end, or the full value rolls over as Account Credit if no slot is available.

A sick cancellation made 1 hour or less before the start time uses the sick day and is treated under the late-cancellation rule above, returning 50% as Account Credit with no reschedule.

In the event of a genuine last-minute illness or injury, Play Strong LLC may, at its sole discretion, waive these penalties.

Account Credit terms

Account Credit is applied toward the client's next purchase of lessons. It carries no cash value, cannot be redeemed for cash, and cannot be transferred outside the household. Account Credit is earned in one month and may only be applied to a purchase in the following month. Any Account Credit not used on the following month's purchase is forfeited.

Weather

Lessons canceled by the instructor due to lightning, heavy rain, or other unsafe conditions are rescheduled at no cost and do not consume a Token or count against the monthly allowance. Light rain is not grounds for cancellation. Client cancellations made 1 hour or less before the start time, upon arrival, or after the start time are not eligible for weather protection and fall under the rules above.

5. Health Disclosure

Clients are responsible for disclosing any relevant medical conditions, physical limitations, allergies, or disabilities prior to the start of lessons. Play Strong LLC is not liable for complications arising from undisclosed health information.

6. Safety and Liability

All students must follow instructor safety directions at all times. Play Strong LLC is not responsible for injuries, accidents, or damages except in cases of gross negligence by the instructor. A parent or guardian must be present and within sight during all lessons. Play Strong LLC complies with applicable Florida state regulations governing aquatic instruction for minors.

Play Strong LLC may photograph or video record sessions for the purpose of documenting student progress or for use on our website and social media. By enrolling, you consent to this use unless you notify us in writing prior to the start of lessons that you do not consent. Images or videos will never be shared in a way that identifies a minor by full name without explicit written parental consent.
